Terms & conditions for the use of alternative book files

Upon request, Emerald Publishing Limited (“Emerald”) will provide an electronic file, in PDF or EPUB format (“Emerald File”), to an educational institution (“Institution”), for use by students or members of staff at the Institution who are unable to access and enjoy the print or ebook versions due to their visual, hearing, cognitive, or motor impairments (“Qualifying Individuals”).

The Institution agrees that the supply of the Emerald File is subject to the following terms and conditions relating to usage and onwards distribution, and where necessary the Institution shall make the Qualified Individual aware of relevant terms and conditions:

  1. The Electronic File is provided for:
    • personal use, non-commercial use by a Qualifying Individual; or
    • in order to create a version of the book in an alternative format for circulation to Qualifying Individuals only and such Qualifying Individuals shall only use such materials for personal, non-commercial use (“Alternative Formats”).
  2. Qualifying Individuals must have purchased (or had purchased on their behalf by the Institution) a copy of the relevant Emerald book. Emerald may ask to see proof of purchase.
  3. The Emerald File, and any Alternative Formats created from the Emerald File, may not be made accessible or provided to any person other than Qualifying Individuals and must not be used for any commercial purposes(s).
  4. If the Emerald File is being supplied as is to a Qualifying Individual, the file must be copy-protected or the Institution must notify the Qualifying Individual that they must not copy or distribute the Emerald File to others.
  5. If the Emerald File is being used to create an Alternative Format, Emerald understands that the Emerald File may need to be stored on a secure computer system to create the required Alternative Format.
  6. Beyond any manipulation required to create Alternative Format(s), the integrity of the book must be respected at all times. The Emerald File must not be adapted, edited, altered, amended or distorted in any way, without the prior written permission of Emerald. Author’s names and copyright notices must not be removed so that the moral rights of authors are at all times respected. The Emerald File should be deleted once the Alternative Format has been created.
  7. The Institution hereby acknowledges that this permission does not grant any rights to the Institution in the Emerald book, the Emerald Files or Alternative Formats (“Materials”) other than the limited rights expressly set forth above. This means that these terms and conditions do not operate to change or transfer the ownership/licensing arrangements of any copyright and other intellectual property rights in the Materials and the copyright in the Materials will remain with the holder of the copyright.
